The law

Special attention must paid to the law of 21 February 2005 amending the Judicial Code as regards mediation (Moniteur Belge of 22 March 2005, p12772).

The law makes a distinction between voluntary (or conventional) mediation and court-ordered mediation (to the which the parties turn when judicial proceedings are already being dealt with). There is reason to add free mediation to this which does not come within the law's enforcement regime.

Check if your mediator is accredited by the Federal Mediation Commission.
